The author argues that simple constructive dilemma is a valuable argument form for reasoning under relative conditions of uncertainty. When applied to legal argument this value of simple constructive dilemma is shown in its political, strategic, rhetorical, and especially economic, uses by lawyers and judges. After considering some examples of the use of the form by trial lawyers, the author gives examples of the more interesting use of the form by appellate courts. Research into the use of simple constructive dilemma (...) by appellate courts helps us to understand how those courts distribute judicial resources. It also helps us to understand the political role of the appellate courts with respect to the doctrine of the separation of powers. Given some of the specific examples of legal reasoning used by the appellate courts presented in this article, and given the discussion of the doctrine of precedent, the article’s focus is on common law legal systems of the Anglo-American-type. This paper defends a novel account of how to determine the intrinsic value of possible worlds. Section 1 argues that a highly intuitive and widely accepted account leads to undesirable consequences. Section 2 takes the first of two steps towards a novel account by clarifying and defending a view about value-contribution that is based on some of W. D. Ross’ claims about the value of pleasure. Section 3 takes the second step by clarifying and defending a view about value-suppression that (...) is based on Ross’ claims about the interplay between prima-facie duties. Section 4 states and defends the account that I call Rossian Totalism. According to this account, the atoms of intrinsic value within a world only sometimes contribute their intrinsic value to the value of that world. (shrink)

Ethical arguments about caregiver responsibility and the limits of client autonomy rely on best evidence about the risks and benefits of medical interventions. But when the evidence is unclear, or when the peer-reviewed literature presents conflicting accounts of the evidence, how are clinicians and their clients to recommend or decide the best course of action? Conflicting evidence about the outcomes of home and hospital birth in the peerreviewed literature offers an opportunity to explore this question. We present the contrary evidence (...) and describe the social and cultural elements that influence the production of the science of birth, including professional, publication, and critical bias. We then consider how the science of birth has been used an misused in making ethical arguments about preferred place of birth. We conclude with a number of recommendations about the responsible use of the evidence, arguing for an “ethics of information” that can be drawn on to guide caregivers and clients in the use of evidence for clinical decision making. Objectives— To explore British community pharmacists' views on PAS , including professional responsibility, personal beliefs, changes in law and ethical guidance.Design— Postal questionnaireSetting— Great BritainSubjects— A random sample of 320 registered full-time community pharmacistsResults— The survey yielded a response rate of 56%. The results showed that 70% of pharmacists agreed that it was a patient's right to choose to die, with 57% and 45% agreeing that it was the patient's right to involve his/her doctor in the process and to use (...) prescription medicines, respectively. Forty-nine per cent said that they would knowingly dispense a prescription for use in PAS were it to be legalised and 54% believed it correct to refuse to dispense such a prescription. Although 53% believed it to be their right to know when they were being involved in PAS, 28% did not. Most pharmacists said that they would wish to see the inclusion of a practice protocol for PAS in the code of ethics of the Royal Pharmaceutical Society of Great Britain in the event of a change in the law on PAS. In addition, 89% would wish to see PAS included in the Conscience Clause of the CE-RPSGB. Males were found to be significantly less likely to favour PAS than females , as were those declaring an ethnic/religious background of consideration when dealing with ethical issues in practice compared with their counterparts .Conclusion— Pharmacists view their professional responsibility in PAS to be more obligatory than a physician's, in having to provide the means for PAS. It is worrying that a proportion of the respondents prefer to remain in ignorance of the true purpose of a prescription for PAS; a finding at odds with current developments within the pharmaceutical profession. A practice protocol for PAS and an extension of the conscience clause should be considered in the event of PAS becoming legal. Such measures would allow the efficient provision of the pharmaceutical service whilst at the same respecting the personal beliefs of those who object to cooperating in the ending of a life. This book aims to provide an introduction to Aristotle's Politics, highlighting the major themes and arguments offered in the scholar's work. The dissertation does not attempt to develop a critical policy science. It attempts to investigate the possibility of one raised by writers such as Habermas. The question arises because the policy sciences are increasingly beset by aporias. These aporias are occasioned by widening perception of the limits of societal rationalization, by worries about "destructuration," and by the increasingly ideological nature of policy science. ;The first section traces the origins of the policy sciences and their development, particularly during the late nineteenth (...) and early twentieth centuries. In this period, as today, governments, foundations, and professional societies, as well as economic, political, and social events, were instrumental in defining social- and policy-scientific problems and methodologies. From this, I extrapolate the fundamental assumptions of conventional policy science--the default theory. ;The next section criticizes basic elements of the default theory as to the nature of social science and social explanation. I argue that social sciences are sciences of various aspects of intentionality and the policy sciences are best conceived of as disciplinary technologies, in Foucault's sense. I then analyze intentionality more closely and develop a theory of social explanation that accommodates it. ;The third section criticizes the elements of the default theory as to morality and legitimacy, particularly claims that rational choice theory tells us something useful about morality. It does this only indirectly by contributing to a better theory of moral error. I next discuss the duality of moral standpoints and the difficulties this creates for solving the problem of legitimacy. The discussion shows, among other things, why utilitarianism fails. ;The concluding chapter argues that Habermas' proposal for a critical policy science based on undistorted rational agreement also fails. It is a self-estrangement theory and, however attractive it is to contemplate this ideal, it fails to project a system that is motivationally reasonable to live by.
